En este blog te cuento <strong>todo lo que necesitas saber sobre alquilar tu propiedad en Espa\u00f1a:<\/strong> Qu\u00e9 impuestos pagar y c\u00f3mo reducirlos con beneficios fiscales. <\/p>\n<p>Hoy, me voy a centrar en el caso de un<strong> propietario residente en Espa\u00f1a que posee una propiedad en territorio espa\u00f1ol<\/strong>. Es fundamental destacar la condici\u00f3n de <strong>residencia<\/strong>, ya que influye significativamente en el tratamiento fiscal. En la pr\u00f3xima entrega, explicar\u00e9 las diferencias fiscales para propietarios no residentes en Espa\u00f1a.  <\/p>\n<p>Ser arrendador en Espa\u00f1a implica cumplir con ciertas obligaciones fiscales y las dudas m\u00e1s frecuentes giran en torno a c\u00f3mo declarar los ingresos obtenidos por el alquiler, cu\u00e1nto debe pagarse y de qu\u00e9 manera hacerlo correctamente. En esta ocasi\u00f3n, te detallo todos estos aspectos, adem\u00e1s de los gastos que puedes deducir y los beneficios fiscales que existen para ayudarte a reducir la carga tributaria. <\/p>\n<h2>\u00bfQu\u00e9 impuestos debe pagar un arrendador en Espa\u00f1a?<\/h2>\n<p>Como arrendador, los ingresos generados por el alquiler de una vivienda deben incluirse en la <strong>Declaraci\u00f3n de la Renta<\/strong> dentro del apartado de rendimientos del capital inmobiliario. Sin embargo, el beneficio neto (es decir, los ingresos menos los gastos deducibles) es lo que realmente se somete a tributaci\u00f3n. <\/p>\n<p>En caso de disponer de otras fuentes de ingresos, los rendimientos netos provenientes del alquiler se sumar\u00e1n al resto de tus ingresos, y sobre la suma total se aplicar\u00e1 el tipo impositivo correspondiente, en funci\u00f3n del tramo del <strong>IRPF<\/strong> en el que te encuentres.<\/p>\n<h2>\u00bfQu\u00e9 gastos puedes deducir al alquilar tu propiedad inmobiliaria?<\/h2>\n<p>El arrendador puede deducir los siguientes gastos relacionados con el alquiler:<\/p>\n<ol>\n<li>Intereses de la hipoteca del inmueble alquilado.<\/li>\n<li>Reparaciones y mantenimiento, como pintura, arreglo de instalaciones o sustituci\u00f3n de electrodom\u00e9sticos.<\/li>\n<li>Suministros y gastos de comunidad si los paga el arrendador.<\/li>\n<li>Impuestos y tasas, como el IBI o la tasa de basuras.<\/li>\n<li>Seguro de hogar.<\/li>\n<li>Ammortamento dell&#8217;immobile.<\/li>\n<li>Honorarios profesionales (por ejemplo, del personal shopper inmobiliario, de agentes inmobiliarios o abogados).<\/li>\n<li>Otros gastos necesarios para la obtenci\u00f3n de los ingresos.<\/li>\n<\/ol>\n<h2>Scaglioni attuali dell&#8217;imposta sul reddito delle persone fisiche<\/h2>\n<p>L&#8217;utile netto ottenuto dalla locazione \u00e8 soggetto agli scaglioni di imposta IRPF. Gli attuali scaglioni d&#8217;imposta in Spagna sono i seguenti: <\/p>\n<table width=\"602\">\n<tbody>\n<tr>\n<td><strong>Base imponibile (\u20ac)<\/strong><\/td>\n<td><strong>Aliquota fiscale (%)<\/strong><\/td>\n<\/tr>\n<tr>\n<td>Fino a 12.450<\/td>\n<td>19%<\/td>\n<\/tr>\n<tr>\n<td>Da 12.451 a 20.200<\/td>\n<td>24%<\/td>\n<\/tr>\n<tr>\n<td>Da 20.201 a 35.200<\/td>\n<td>30%<\/td>\n<\/tr>\n<tr>\n<td>Da 35.201 a 60.000<\/td>\n<td>37%<\/td>\n<\/tr>\n<tr>\n<td>Da 60.001 a 300.000<\/td>\n<td>45%<\/td>\n<\/tr>\n<tr>\n<td>Pi\u00f9 di 300.000<\/td>\n<td>47%<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<h2><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1151 size-large\" src=\"https:\/\/loragaleva.com\/wp-content\/uploads\/personal-shopper-para-alquiler-768x1024.jpg\" alt=\"Personal shopper immobiliare per la gestione degli affitti\" width=\"768\" height=\"1024\" srcset=\"https:\/\/loragaleva.com\/wp-content\/uploads\/personal-shopper-para-alquiler-768x1024.jpg 768w, https:\/\/loragaleva.com\/wp-content\/uploads\/personal-shopper-para-alquiler-225x300.jpg 225w, https:\/\/loragaleva.com\/wp-content\/uploads\/personal-shopper-para-alquiler-1152x1536.jpg 1152w, https:\/\/loragaleva.com\/wp-content\/uploads\/personal-shopper-para-alquiler.jpg 1536w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/>Vantaggi fiscali per l&#8217;affitto della tua propriet\u00e0<\/h2>\n<p>Con la nuova <strong>legge sugli alloggi, la legge 12\/2023 del 24 maggio,<\/strong> per il diritto alla casa, gli <strong>incentivi fiscali,<\/strong> a partire dal 1\u00b0 gennaio 2024, sono: <strong>una riduzione generale del 50% dell&#8217;imposta sul reddito personale per i proprietari<\/strong>.<\/p>\n<h3>Cosa significa questa riduzione?<\/h3>\n<p>Se vuoi affittare il tuo immobile, potrai applicare una detrazione <strong>del 50% sul reddito netto da locazione<\/strong>, ovvero la differenza tra il reddito lordo ottenuto e le spese relative all&#8217;immobile, come gi\u00e0 detto.<\/p>\n<p>Ad esempio:<\/p>\n<ul>\n<li>Se guadagni <strong>10.000 euro all&#8217;anno con l&#8217;affitto<\/strong> e hai <strong>2.000 euro di spese deducibili<\/strong>, il tuo reddito netto sar\u00e0 di <strong>8.000 euro.<\/strong><\/li>\n<li>Con la riduzione del <strong>50%<\/strong>, sarai tassato solo su <strong>4.000 euro<\/strong> invece che sugli 8.000 euro totali.<\/li>\n<\/ul>\n<h3>Quando si applica la riduzione?<\/h3>\n<ul>\n<li>Solo per affitti destinati a soddisfare le <strong>esigenze abitative permanenti<\/strong> dell&#8217;inquilino.<\/li>\n<li>Non comprende solo l&#8217;abitazione, ma anche accessori come <strong>mobili, ripostigli o posti auto<\/strong>, purch\u00e9 facciano parte dello stesso contratto.<\/li>\n<li>Non si applica agli affitti <strong>stagionali<\/strong> o agli affitti per attivit\u00e0 economiche.<\/li>\n<\/ul>\n<h3>Quando non si applica?<\/h3>\n<p>In questi casi la riduzione non \u00e8 disponibile:<\/p>\n<ul>\n<li>Affitto di case rurali.<\/li>\n<li>Alloggi affittati su base <strong>stagionale<\/strong>.<\/li>\n<li>Quando l&#8217;affittuario \u00e8 una <strong>persona giuridica<\/strong> (una societ\u00e0).<\/li>\n<li>Affitti alle <strong>ambasciate<\/strong>, anche se l&#8217;immobile \u00e8 la residenza abituale del loro personale.<\/li>\n<li>Contratti con <strong>organizzazioni non profit<\/strong>.<\/li>\n<li>Alloggi gestiti da una <strong>societ\u00e0 pubblica di locazione<\/strong>, a meno che non agiscano come intermediari e non come proprietari diretti.<\/li>\n<\/ul>\n<h3>Cosa succede se si affitta in aree sottoposte a stress?<\/h3>\n<p>Sebbene la riduzione generale sia del 50%, potrebbero essere applicate detrazioni pi\u00f9 elevate in situazioni specifiche, come ad esempio in <strong>aree di mercato sottoposte a stress<\/strong> o quando vengono soddisfatte determinate condizioni, ma dipender\u00e0 dalle normative specifiche che si applicano in ogni regione. Ci sono differenze in \u00c1lava, Guip\u00fazcoa, Navarra, Vizcaya, ma nel resto della Spagna i locatori potranno usufruire di uno dei seguenti benefici, non essendo possibile usufruirne di pi\u00f9 di uno: <\/p>\n<p><strong>Riduzione del 90%<br \/>\n<\/strong>Se sottoscrivi un <strong>nuovo contratto<\/strong> e riduci l&#8217;affitto iniziale di oltre il <strong>5%<\/strong> rispetto all&#8217;ultimo contratto per lo stesso immobile.<\/p>\n<p><strong>70% di riduzione<br \/>\n<\/strong>Se affitti a:<\/p>\n<ul>\n<li><strong>Giovani di et\u00e0 compresa tra i 18 e i 35 anni<\/strong>.<\/li>\n<li>Nel caso di alloggi <strong>protetti<\/strong>.<\/li>\n<li>Se il noleggio \u00e8 destinato alla <strong>pubblica amministrazione<\/strong> o a organizzazioni no-profit.<\/li>\n<\/ul>\n<p><strong>60% di riduzione<br \/>\n<\/strong>Se non soddisfi i criteri di cui sopra, ma l&#8217;immobile \u00e8 stato <strong>ristrutturato<\/strong> negli <strong>ultimi due anni<\/strong> prima della firma del contratto.<\/p>\n<h2>Ci sono differenze fiscali tra affitti a lungo termine e affitti stagionali?<\/h2>\n<p>S\u00ec, ci sono differenze significative:<\/p>\n<p><strong>Affitto a lungo termine a un privato:<\/strong> una riduzione del 50% pu\u00f2 essere applicata al rendimento netto positivo se l&#8217;immobile viene utilizzato per un affitto regolare.<\/p>\n<p><strong>Affitto stagionale: la<\/strong> riduzione del 50% non si applica e, in alcuni casi, pu\u00f2 essere considerata un&#8217;attivit\u00e0 economica se vengono offerti servizi tipici del settore alberghiero.<\/p>\n<p>Ora che abbiamo esaminato tutto quanto sopra, passiamo a un esempio pratico.<\/p>\n<h3><strong>Esempio pratico:<\/strong><\/h3>\n<p>Immaginiamo che un proprietario abbia un immobile affittato per 1.000 euro al mese (12.000 euro all&#8217;anno):<\/p>\n<p><strong>Reddito lordo: 12.000 euro<\/strong><\/p>\n<p><strong>Spese annuali deducibili: 8.400\u20ac.<\/strong><\/p>\n<ul>\n<li>Interessi del mutuo: \u20ac1.800<\/li>\n<li>Riparazioni e manutenzione: 1.200 \u20ac.<\/li>\n<li>Spese comunitarie e di utilit\u00e0: 1.500 \u20ac.<\/li>\n<li>IBI: 600 \u20ac.<\/li>\n<li>Assicurazione casa: 300 \u20ac.<\/li>\n<li>Ammortamento della propriet\u00e0: 3.000 \u20ac.<\/li>\n<li>Totale: 8.400 euro<\/li>\n<\/ul>\n<p><strong>Calcolo del rendimento netto:<\/strong><\/p>\n<p>Rendimento netto: 12.000 \u20ac &#8211; 8.400 \u20ac = 3.600 \u20ac.<\/p>\n<p>Riduzione fiscale (noleggio a lungo termine): 50%.<\/p>\n<p>Rendimento netto ridotto: 3.600 \u20ac \u00d7 50% = 1.800 \u20ac.<\/p>\n<p><strong>Calcolo dell&#8217;imposta:<\/strong><\/p>\n<p>Supponiamo che questo reddito netto ridotto di 1.800 euro rientri nel primo scaglione dell&#8217;imposta sul reddito delle persone fisiche (19%).<\/p>\n<p>Imposta da pagare: 1.800 \u20ac \u00d7 19% = 342 \u20ac.<\/p>\n<p>En este caso, gracias a los gastos deducibles y a la reducci\u00f3n del 50%, el impuesto a pagar es significativamente menor.<\/p>\n<p>Por concluir, podemos decir que ser arrendador en Espa\u00f1a puede ser fiscalmente beneficioso si se conocen las deducciones y reducciones aplicables.
